1. Agreement to Terms
By accessing or using Buddy List, provided by WexCode LLC ("we," "us," or "our"), you agree to be bound by these Terms of Service. You must be at least 16 years of age to use this Service. If you are under 16, you are not authorized to create an account. If you are between 16 and 17 years old, you represent that your parent or legal guardian has reviewed and agreed to these Terms.
2. Description of Service
Buddy List is a mobile application that helps you stay connected with friends by showing when they're available to talk. The app uses your phone number for account identity and friend discovery.
3. User Accounts
You are responsible for providing accurate information (Name, Email, Phone) and for all activity occurring under your account. You agree to secure your device to prevent unauthorized access.
4. User Conduct
You agree not to use the Service for any unlawful purposes, or to interfere with the operation of the Service. This includes:
- Phone Discovery: You acknowledge that your phone number acts as a "discovery key." Users who already have your number may find your profile.
- Mutual Consent: You may only view a user's phone number if they have explicitly approved your connection.
- Abuse: You agree not to use the Service to harvest user data or harass other members.
- Scraping: You may not use automated means to scrape, harvest, or extract data from the Service.
5. Contact Matching Permission
You grant us permission to process phone numbers from your device address book solely to identify existing users. We do not store this contact data.
6. Intellectual Property
All content, code, and design within Buddy List are the exclusive property of WexCode LLC. You may not copy, modify, or distribute any part of the Service without our prior written consent.
7. Administrative Access
You acknowledge that WexCode LLC administrators have access to records and dashboards for technical debugging, platform safety, and customer support.
8. Limitation of Liability
To the maximum extent permitted by law, WexCode LLC shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service. The Service is provided "AS IS" without warranties of any kind, express or implied.
We do not guarantee that the Service will accurately reflect the real-time availability of your connections. You acknowledge that availability status may be delayed or inaccurate due to network conditions or device states.
9. Termination
We may terminate your account at our discretion for violations of these Terms. You may delete your account at any time via the Settings page. Account deletion results in the purging of your personal information from our active database.
10. Changes to These Terms
We may modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the app. Your continued use of the Service after changes constitutes acceptance.
11. Governing Law
These Terms are governed by the laws of the State of California. Any legal action must be filed in the courts located in Los Angeles County, California.
12. Apple App Store Terms
You acknowledge that these Terms are between you and WexCode LLC only, not with Apple Inc. Apple has no obligation to furnish any maintenance or support services, handle any product claims, or address any third-party intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
13. General Provisions
Severability: If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.
Entire Agreement: These Terms constitute the entire agreement between you and WexCode LLC regarding the Service.
Waiver: Our failure to enforce any right or provision does not constitute a waiver of that right.
